§ 1305. Initiation of comprehensive plan amendment.

A private property owner who has received a determination from the director that a
proposed rezoning application is inconsistent with the comprehensive plan may file
an application to amend the character map or future land use map, or both, of the
adopted comprehensive plan, as it pertains to the property owned, in accordance with
the requirements of this division; provided, however, that an application for a comprehensive
plan amendment affecting the same property shall not be considered by the board of
commissioners more often than once every 12 months unless the board of commissioners
upon application approves a reduction in the waiting period as it deems appropriate
for extenuating circumstances.
