§ 26-57. Adult bookstores and movie houses.

  • (a)

    Zoning restrictions. No adult bookstore or adult movie house, as defined in this section, shall be permitted except in an area zoned for such purposes, subject to the restrictions imposed by this section.

    (b)

    Distance restrictions. Each adult bookstore and adult movie house is prohibited from operating within 200 yards of any church, church bookstore, public park, public housing project, hospital, school (public or private), college, recreation center or private residence, herein known as the "enumerated uses."

    (c)

    Measurement. Distances shall be measured in a straight line from the property line nearest to the enumerated uses of the tax map lot where such adult bookstore or adult movie house is located to the nearest property line where such an enumerated use is located.

    (d)

    Definitions. The terms "adult bookstore," "adult movie house," "sexual conduct" and "nudity" are defined as set forth in O.C.G.A. § 36-60-3, which is incorporated in this section and made a part hereof by reference.

    (e)

    Restrictions on occupation tax registration. No occupation tax registration shall be made for purposes in conflict with this section, nor shall any building permit be issued in violation hereof.
