§ 30-4. Removal.

  • The county road superintendent is authorized to immediately and without notice confiscate and remove any basketball hoop or other recreational device, or any other encroachment within a county road or county road right-of-way. Any basketball hoop or other recreational device that is confiscated by the road superintendent may be claimed from the county road department within one week of confiscation. A charge to cover the county's cost for removal and storage of the hoop or device will be assessed, and payment must be made before the hoop or device is released to its owner. Any such hoop or device that is not claimed and released within one week of confiscation may be donated or otherwise disposed of by the county.

    The county road superintendent and any of its subcontractors are authorized to, without notice, remove any landscaping, fence, wall, curbing or curb supplement installed within a county right-of-way without authorization, or any other physical obstruction within a county right-of-way that has not been approved by the county road department. A charge to cover the county's cost for removal will be assessed to the private property owner of record abutting the encroachment.
