§ 8-71. Public nuisance animals.

  • (a)

    The owner of any domestic animal shall be in violation of this chapter if the animal exhibits or engages in any of the following behaviors or activities:

    (1)

    Damages public property or private property other than its owner's;

    (2)

    Chases vehicles, bicycles, or people;

    (3)

    Is repeatedly found at large;

    (4)

    Attacks without provocation;

    (5)

    Causes unsanitary or offensive conditions or otherwise endangers public health, welfare or safety;

    (6)

    Is in heat and not confined within a secure enclosure to prevent unintentional breeding; or

    (7)

    Causes serious annoyance to a neighboring residence and interferes with the reasonable use and enjoyment of that property, including, but not limited to, making any vocalizations for more than 15 minutes without interruption or more than 30 minutes if the vocalization is intermittent between the hours of 12:00 a.m. and 6:00 a.m. These time limits do not apply if the vocalizations are given as a warning to the presence of an intruder. Officers enforcing this subsection are not required to measure the vocalizations with the use of any device. Upon notification of a complaint concerning such vocalizations which provides the officer with the address of the owner, the owner of such animal shall be given a written warning indicating that such animal is creating a disturbance. If the disturbance is not resolved within two calendar days, or if a subsequent complaint is made for such animal by a different individual, who resides at a different location from the first complaint, a citation shall be issued to the owner.

    (b)

    Any such public nuisance animal that exhibits or engages in any of the behaviors or activities identified in subsection (a) may be impounded and the owner charged for a violation of this article.
